My Wishes Are Privacy Policy

The My Wishes Are platform, website and all associated applications and services (My Wishes Are) are provided by My Wishes Are Pty Ltd ACN 622 158 963 (us, we, our). This policy forms part of our Terms of Use Agreement and will apply to anyone who uses or accesses My Wishes Are (you, your, Member, Nominee – as applicable).

Your privacy is very important to us, which is why we will only handle your personal information in accordance with this policy. Please ensure that you read this policy, which sets out how we collect, hold and disclose personal information, prior to using My Wishes Are.

Capitalised terms not defined in this policy have that meaning given to them in the Terms of Use Agreement.

What information do we collect and hold?

We may collect and hold a variety of information from you while using My Wishes Are. This may include information or an opinion which can, or might reasonably be expected to be able to be used to personally identify you (Personal Information).

The type and amount of Personal Information which we collect depends on how you use My Wishes Are (for example, whether you are a Member or a Nominee). We aim to only collect Personal Information which is reasonably necessary for us to provide My Wishes Are.

Some types of Personal Information we may collect includes your:

  1. name;
  2. age and date of birth;
  3. email address;
  4. physical mailing address;
  5. photographic identification;
  6. Payment Method details;
  7. transaction and enquiry history with us; and
  8. any other information you elect to disclose to us through interacting with My Wishes Are, such as by entering Member Content or communicating with our support team.

We may also collect and hold other types of information about your interaction with My Wishes Are as set out in this policy.

How do we collect Personal Information?

We generally collect Personal Information directly from you in the following ways:

  1. through your use of our My Wishes Are, such as when you create your Account or enter Member Content;
  2. through communications between you and our representatives or support team;
  3. whenever you purchase a Membership; and
  4. whenever you participate in our promotional offers.

We may also collect your Personal Information from third parties such as:

  1. if you are a Nominee, from the Member who has nominated you;
  2. our business partners and contractors, such as those who provide promotional offers related to us;
  3. our third party payment service providers;
  4. social media sites where you have connected your account with My Wishes Are or where you have visited our social media pages.

How do we hold Personal Information?

Any personal information stored by our site is securely stored on servers hosted within Australia, and communicated using SSL encryption.

We have taken all reasonable steps, including implementing a number of commercially standard security systems and procedures, to prevent any misuse, loss, interference, modification or unauthorised access or disclosure of your Personal Information.

Stored Personal Information about you may be combined or linked with any other information about you that we hold, including any information we receive from third parties.

What do we use Personal Information for?

We will never share, sell or rent your Personal Information to third parties other than as disclosed in this policy. In particular, we will never provide your email address to third party advertisers without your consent.

We collect, hold, use and disclose Personal Information to:

  1. provide My Wishes Are;
  2. provide you and your approved Nominees with access to My Wishes Are and Member Content;
  3. provide you with updates when Member Content has been edited or a Nominee has been appointed/revoked;
  4. send reminder emails about whether an Account is to remain active;
  5. monitor the use of My Wishes Are and your Account;
  6. assess compliance by any person with this agreement;
  7. collect information that assists us in improving My Wishes Are; and
  8. assess your identity and eligibility for using My Wishes Are;
  9. provide you with updates regarding My Wishes Are;
  10. provide you with news and information on promotional offers or competitions, upcoming events and products offered by us either solely or in conjunction with our third party affiliates;
  11. provide support and communicate to you as our customer;
  12. manage your Account;
  13. process transactions and delivery of login credentials to you;
  14. provide information to our related bodies corporate for their business operations;
  15. disclose to our external service providers including, but not limited to, our data hosting partners and IT service providers;
  16. use for our planning, research, maintenance and administrative purposes;
  17. to provide to third parties where disclosed to you in this policy or otherwise where authorised by you;
  18. investigate and respond to any claim, dispute or complaint made by or against you or to investigate any unlawful or improper use of My Wishes Are;
  19. transfer, as part of a transfer of our assets should we propose or proceed to sell, merge or otherwise alter ownership of our business; and
  20. carry out any act permitted or required by law.

Despite the above, whilst Member Content is collected and stored via My Wishes Are, we do not view or access any Member Content other than your name, email address, billing information and promotional codes. Accordingly, a Member’s specific funeral and burial wishes and directions, including any Personal Information therein, are not accessible by us and are not used for any of the purposes listed above. Only a Member and their Nominees are authorised to access the funeral and burial wishes and directions of a Member as specified in that Member’s Member Content.

In circumstances where we determine it is commercially viable to do so, we will attempt to carry out any of the above listed purposes without using Personal Information or de-identifying Personal Information first. We will take reasonable steps to de-identify or destroy any Personal Information where it is no longer needed for the purposes provided for in this policy.

Other Information & Third Parties

Whilst you are using My Wishes Are, we and other third parties may also collect and hold other non- personal information by using cookies or other technologies. Cookies allow tracking and storage of information about your use of My Wishes Are either directly or through third parties.

In some cases, you can choose not to provide us with information by setting your browser to refuse cookies, however this may restrict your ability to fully interact with My Wishes Are.

Cookies are used by us for various reasons including to:

  1. store your username and password for accessing an Account on a device so you do not have to re-enter it;
  2. generate statistical information and reports about your use of My Wishes Are;
  3. combine information about your usage patterns with similar information obtained from other users to help improve My Wishes Are.

We may also implement other technologies to obtain information for reasons similar to those above. This information may occasionally be shared with our third party affiliates; however this will never include Personal Information. Please note that we cannot control or be responsible for the use of cookies or other technologies implemented by third parties.

Promotional offers or any other content or website that is created or hosted by a third party, but is accessed by you via My Wishes Are (through embedding, hyperlink or otherwise), may be subject to that third party’s own privacy and data collection policies and practices which may vary from our own.

If you voluntarily disclose Personal Information to a Nominee via your Member Content you do so at your own risk as we cannot control how a Nominee will use that Personal Information.

International Disclosure of Personal Information

Our business is solely based in Australia. We will not intentionally disclose your Personal Information overseas for any purpose. If we do need to disclose Personal Information overseas we will update this policy accordingly in advance and will take reasonable steps to ensure that overseas recipients handle Personal Information in accordance with our policy.

Accessing and updating your Personal Information

You have a right to request access to and seek correction of any Personal Information we hold about you. You can make this request via the contact details at the end of this policy.

Complaints

We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (the Act).

If you have complaints, comments or concerns regarding the Act or this policy, please first contact us directly via the contact details at the end of this policy. We will endeavour to get back to you as soon as possible, but we ask that you allow us up to 30 days to respond before taking any other action.
